He's using the terms wrong I believe. If the township has ROW, they own the land. If he still owns the land but the township has use of it for a road, the township has a perpetual easement. "Owning the dirt under ROW" does not make sense to me. What I would bet the situation is is the township owns the land to the ROW line.


Maybe I did use the wrong term. I went to the county recorders website and looked up a recent example. They called it a "Perpetual easement for highway purposes". Landowner received compensation but retains ownership of the land while the county gets to use the surface for highway purposes. Utility companies can use the easement, but as you pointed out in your other post, the utility company must be recognized by PUCO.
