Malta, Illinois | Trespass laws in Illinois seem a bit murky. It has been my understanding that if a property is not posted you have to verbally ask the offending party to leave before you can press charges. If they don't leave then you can press charges. Even if a property is posted I am not 100% certain that you don't have to ask them to leave before pressing charges. Seems kind of dumb but I think that is the way it is. I know people that have attempted to press charges for trespass and LEO and States Attorneys are very reluctant to do so. I do not know why other than sheer laziness. If someone is dead set against having PFT in their fields I would at a minimum have my fields posted. I am amazed that some enterprising ambulance chaser has not filed a class action lawsuit against PFT for their repeated stops without an invitation. There must not be much meat on that bone. | |
