I think that an initial conversation and time spent with a prospective customer is part of sales or selling yourself.
You don’t get billed by an equipment dealer when you meet with a salesman and price out a combine you don’t buy. Or owe a seed salesman when they give you a quote and you go another route. Even if you buy the same seed they quoted you.
At the point you sign a contract with the builder is when money is usually due even if you back out.
Now that being said, you know the situations and how the conversations went. If you were up front with him that you just wanted a bid, I don’t see how you owe him anything. It’s part of selling and companies have to bid jobs all the time with no guarantee of getting the work.
If he’s someone you know and want to compensate him for time that is your call.
If you didn’t lead him on and ask him to throw time and money at it on your behalf, I don’t see why you’d be obligated to pay him a dime without an agreement up front.
Like others have said, talk to him.
