You have to find an attorney that specializes in protecting assets. They aren't cheap to retain, but protecting an asset such as a farm that's been in a family for over 100 years is worth it. The sooner you do it the better , because the government is always changing the rules. when my grandmother had it handled the rule was she had to stay out of the nursing home for three years. After she passed, it was changed to five years. Now I think it's seven, but don't quote me on that. At least that's how it is in Ohio. When my dad passed 2 years ago, he was in a nursing home for five months. The insurance( Etna/ medicare) paid for one hundred days, then you either go on medicaid, or self pay for sixty and then you can go back on insurance. The problem was the insurance would try to get out of a return to them covering. Etna and Medicare would try to pass it back and forth. Self pay was twelve grand a month. Medicaid is dirty on charging too. My best friend worked for a nursing home and he told me when you go on medicaid; they tell the nursing home to charge for anything and everything. "Charge them for the knife and fork, if they eat." They push for medical testing constantly too. They will try for it all, if they find out you own anything. The nursing home my grandmother was in started doing that. Every week it was a run to the hospital for some kind of BS test until my dad had enough and put a stop to it. the One my dad was in asked what he owned the second he came through the door, because he'll need as much money as he can get more than likely. I told them."It's none of your F'n business. We'll self pay after the insurance quits and you'll be told when the times comes we can't. Don't worry though, We can cover for a couple years, if need be. That said, don't start licking your chops and thinking your running up a bill with BS tests and such. We know his condition and it isn't going to improve. All thanks to a hospital and another nursing home that dropped the ball. We can't give him the care he needs, so here we are." They didn't like it, but went with it.
