Where did insurance land on all this? Is his insurance refusing to pay?  Let your insurance company deal with his. The situation sounds pretty "fresh"....insurance isn't known for being speedy. I'd maybe try to get to the bottom of whose coverage does what and let them fight before I was ready to go to court and spend that time and money.
