West Central Illinois | What would you do in this situation? On a rented farm in don't farm the tillable but I run pasture and hay on the place, stalk grazing and covercrop grazing are included on the deal. Had 14 cows on the cereal rye and I just happened to be going by there and noticed looked like a sprayer had been through. Sure enough it was sprayed, the neighbor that farms the tillable hadn't ordered it he wanted to plant beans into the green rye in a week or 2.
I had pretty much just the rye fenced off with temporary polywire and step ins so there is no way they didn't see there was cows on it. Talked to the custom applicator and they said at first they didn't know there was cows on it. Then story changed to "we spray fields with cows on it all the time it's fine." Does that make it right? Was sprayed with roundup and zidua, both have grazing restrictions. Cows were on it a dull day grazing after sprayed before I came through there and saw it. I'm not worried about them all dropping dead but these are P2s and P3s mostly I worry about birth defects, stillborn and aborted calves. Am i out of line to think they should be on the hook for that if it happens?
