My understanding has always been, that when manufacturers went to China, one of the provisions was that they gave up some level of IP for access to Chinese manufacturing and Asian markets. I think that at least some of this argument is disingenuous on Oleary's part. Also, the simple answer would simply be - Don't have your stuff manufactured in China. Done. Why did these companies continue to go back to China for manufacturing if this was such a horrible issue? Is China committing IP "theft" or are manufacturers now simply unhappy with the deals that they made?
The problem is you come up with a new widget, get it patented, even build it here. China monitors the sales volume you achieve, once/if it hits a certain level of sales to show them it’s a hit, they buy one and copy it, flood the market with your widget at 40% discount. And you have no recourse to sue them for patent violation.
