Subject: RE: Michigan land rent termination laws

This is anecdotal so take it for what it’s worth

Prevailing knowledge here is that if you make activity preparing it for the following year, you have already started farming it. This holds especially when you have been there doing it year after year, as it makes some type of implied consent among the law. I saw it happen a number of years ago. A less than reputable farmer was harvesting and immediately working ground behind the combine just to secure the ground one more time. There had been talk about taking it from him, but he operated thru this loophole. Owner fought it and lost. Had to give notice to the tenant to not complete any work after harvest. I lived through one similar where I had a handshake deal with the dad. He passes away, daughter (who is a legal secretary), immediately sends me a letter stating don’t touch it after harvest. They then went a different route for more money. Maybe it’s a Michigan loophole thing. Maybe it’s just urban legend.

Not telling you what to do. Just telling you what Ive seen and heard here in the mitten
