You may want to call Dell a couple more times and complain, particularly if you bought your machine close to Jan 31, 2010. I also bought a new laptop from them, didn't hear from them about the upgrade for awhile, then found on their web site I had to register to receive the upgrade.

I was supposed to receive an email telling me all this, but I never got the email. Then after I registered, I never got the email telling me the update was available.

I believe it took two or three attempts at getting it before I finally received the install CD in the mail.

If you want to pin them down, you can get the information from their own web site about registering, etc. here:

you will also see what has to be done to receive it....although I was never told originally I had to first register my machine to receive it. Ask them to produce the documentation showing you were notified of what you needed to do to receive the upgrade.

Edited to add: If you look at the first link I provided, you can see that information was not even published to their web site until 2/4/2010. One would think a customer oriented company would have put something like that where it could be noticed by their customers prior to the expiration.
