 East Central South Dakota | Some big items in ruling. Ruled Summit is not a common carrier. Would have to disclose contracts if it wants to challenge common carrier. Litigation ahead will focus on whether Summit Carbon Solutions is considered a common carrier under eminent domain law. The court said landowners have the right to discovery in the case to answer that question. The court also questioned whether carbon dioxide is even a commodity. This will once again drag the legislature into the debate. The federal government and 5 states believe it is.
One of the biggest items in the ruling was it was unanimous. That is a big deal. Now we get to hear Gevo, which is just a paper company that lives off of Government grants, whine they are pulling out of the state. They don't have the capital or expertise to build and run a plant.
