SW Ohio | Here are a few things to mull over. If a boundary line (in this case fence) is agreed upon for both sides and is in place for X (depends on the state) years, it IS the property line even if survey says otherwise--known as the doctrine of acquiescence.
I think in Ohio there were some new laws in the last decade that addressed several fence issues, one of which gave the right to a four foot strip on your side of fence to allow construction and maintenance by the party on the other side. And in new developments/plats/subdivisions there is to be a fifteen foot buffer with no activity allowed, no brush clearing or construction in that zone. Also removal of a fence and not replacing it is no-no. | |
