I heard Deere said there was no way they could ramp up production to supply row units. By kinze setting up and building exact copy row units proved Deere was lying (Deere wanted to sell complete planters). By copying the design, it proved a market competition issue, not a supply issue. Kinze was willing to buy the row units. In other words, Deere could not legally deny Kinze from buying row units. But Deere was denying access to the row units and calling it a production problem. If Kinze varied the design, he could have been sued for patent infringement and any design change could be the reason Kinze could build them and Deer could not. Several of the Deere patents were ruled not new or unique. For example, angle closing wheels existed before.

I wonder if there wouldn't be a different outcome if the trial was held today.
