I laugh when people think an LLC is going to shield them from a major law suit or death caused by a semi involved accident. Follow the 3 A’s in regard to lawsuits, can be sued by anyone, anytime for any amount. In regard to LLC protections from said suits, as long as the trucks are owned by the LLC, and the owner of the LLC is not the driver, they will be protected, as the LLC and the driver will be sued. Kiss the assets of the LLC goodbye though. If you have trucks, by all means set up a separate LLC for that entity, and keep out of the truck personally, as if you’re the driver, you’ll be sued personally anyway. |
