They did pass a law lots of them. What the EPA is doing is to align herbicides labels with the endangered species act. Congress also gave the EPA authority to regulate herbicides under the Federal Insecticide, Fungicide, and Rodenticide Act.
A person doesn't have to like to something to agree that it's legal for the government to do.
