Illinois Family Farms Update….

As most of you know, In October Tricky Ricky filed chapter 11 on his leasing company. Then in November he filed chapter 11 with the main company. Here is a link to all of the court documents to date for both cases.

I will try to keep this link updated anytime there are any documents worth updating. The best ones as of now are in the ILLFF folder Item #’s 29 &30. There are lots of claims against all kinds of companies on Delhi road. This is the same road as Agrisolutions & Family Farms. It looks like it costs a lot to be a member of a family farms team. Item #27 is the bank requesting to foreclose on all real estate that was pledged as collateral for this company. (Only 10 acres of it was Ricky’s) The sad thing is that is father passed away in 2009 and he has lost everything his dad work his entire life for in just three years.

The records show 1.7 million in assets (of that 800k in unknown A/R) and over 31 million liabilities.

Is it even possible to lose that much in three years? There are many questions I have on the numbers that he is showing on these documents. He could have gone to Vegas and blew 30k every day for the last three years and not lost that much. Maybe Carlinville National Bank would have loaned him money for that also if it had been on his business plan……

I don't understand how it's possible. If they farmed 30000 ac. For 3 years they lost over 300 dollars a acre.. They almost had to have lots of money going somewhere else?

They paid cash rent up front for three years in advance. I heard from land lords that it was in excess of 300 a year. Also Heard from friend that was in line at ADM ST. Louis that the ricks truck in front of him had corn that was black and steaming. Driver said he had 2 200,000 bins go out of condition. Little things add up.

Honestly, what business is this of yours or anyone elses on here? I sure hope you weren't the one who went to all of the trouble looking up, downloading and zipping these files up for all to see. Well anybody that does business with vendors involved with this has a lil business....I bet you all do business with John Deere...Somebody's costs are going up a little bit due to this...so yea...it would appear alot of us have some business in this.

They had a few more pieces than a typical operator.

It all adds up to.  Makes credit tighter for a multitude of things in their area and could close other businesses that are needed in the communities that they defaulted in.

You are silly to think that . . . .
It does compute into the final cost of machines. JD Finance goes over these losses and knows them dearly.
It's built into the production cost structure and financeing cost structure.
Every company has this cost of business built into expense ration . . .. .
You are paying it, weather you agree / know or not.
Edit: to your credit . . . with the hundreds of millions of dollars of sales, repos would be a small number in there.

I agree with what you say, they know it and know it well--but ILLFF is small potatoes to Deere and Co. Due to drought there will be hundreds of combines, tractors, cotton strippers, sprayers, planters, drills, etc. (many custom operators) defaulted on this year--I am guessing Deere is looking at that a great deal closer than one LARGE operation in Illinois.

We will all pay for the defaults of ILLFF but they are small compared to what is going on in other parts of the country...

Trollerbk.com sends updates everytime there is a filing. It takes no time to keep this link updated. It's well worth 40 buck a month to keep informed, when it has to do with my business.

It is my business because I used to be a partner with this SOB. My name gets associated with him all of the time, so I love watching him go down.

Keep us posted. Don't know the guy but when farm magazines publish stories on guys like this and amke them look like the heros of the day when they are actually screwing over innocent people in the process, I like to see the other side reported.

Most of the landowners that did not get paid were in 2009 & 2010 crop years. In 2011 he had no cash, so he sub rented all acres out to other family farms teams. These teams paid the rents, so no one got shorted this year to my knowledge. This appears to be his plan for next year also. All of the ground is sitting idle with no fall work done. I would hope that the bankruptcy court would treat these as assets and give them to a creditor.

His big thing on writing leases is to do a changeup on the wording for termination dates and that the leases are auto renewing. The standard around here is that the ending date is 02/28 and the termination must be served 6 months prior to this date. Almost every lease he does has different dates. He may say the ending date is 12/31 and he needs to be notified 7 months prior to that date. This would mean that he would need to be notified by 05/31 or he the right to farm the ground next year. This fall he had many owners trying to get out of leases, even ones that were expiring. He then explained to them that they had not notified him in time, so he gets the farm for one more year.

I would think that most land owners will be trying to find new tenants as soon as they can get away from him. He is trying to make $45 per acre sub renting these farms out. Why would any land owner want a middle man for? They would have no control who actually farms their ground. Rick could change sub renters each year. What if the sub renter does not pay up? Rick has no assets to then pay the actual owner. On top of that he pays too much for the ground in the first place. Who would be dumb enough to pay $45 on top of the high rents he has locked in? What a mess….

I find the information very interesting myself. Kudos to Killam! Perhaps you aren't aware of the Top Producer article. Or the use of the quote from the banker saying how bright and wonderful RR was to deal with. He didn't go quietly about his "business". He held himself out as a master of the universe. Now reality is here...the result of such blatant irresponsibility.

I suppose lehman bro's, bear stearns, mf global are none of anyones business too then? This is a multimillion dollar corp that affected many people. I'm sure a majority of people on this board do business with one company or another that is owed money by Illff, the ripple effect may have more of a impact then you might think. IllFF is probably a pretty small drop in the bucket for a company like deere finical but we need to learn from these operations and business structers like this. What happens as time goes by and these rapid expanding operations are 10 times larger and there become serveral more 300,000 acre operations all derived like ILLFF with simlar debt to assets and a bad year of farming comes along.

Compaines that are safe and sound business's for years, you might have prepaided chemicals, seed or fertilizer with suddenly have to stop operations since they can't make payroll because a couple 300k acre farms couldnt pay there bills and they have your money and you got no product. Don't get me wrong expensaion can be good but we need to make sure its done properly!

BRAVO!! Excellent point!

ILFF like to draw a LOT of attention to themselves - so as far as I'm concerned, let's keep the spotlight on them. I would think differently if they did what they did in a more low-key way - but they did it with a major "look at me" attitude - and shouldn't expect the closing act to happen with the curtains closed.

I noticed two of their unsecured creditors are from Salina, KS. That is interesting I wonder how they got mixed up with them. Accountinng firm and a law firm.

It is a sad deal for all involved. Nobody wins in this deal. For those small businesses in Carlinville, IL it will be a big hit on their bottom line. ADM, Deere, Cargill and others will be able to absorb it but it still has a negative impact on their operations. Will it break them? No but it sure doesn't help them.

When a man thinks of himself and holds himself in such high regard to acomplish his agenda, and does not worry about anyone else except himself, he then makes it everyones business. Ask the farmers around Carlinville and surrounding areas if it is their business. Ask the local bank and businesses who are owed money and their customers if it is any of their business. Ask the employees of ILLFF and their families if it is any of their business. Unfortunately many people are affected by this and will be for many years to come. Lines are drawn deep in the sand and emotions are running high.

You just cant build your business while jumping up and down in the lime lite and then expect to step to the side of it when things turn south and hope nobody notices. Come on now, this is what he wanted, the fame , the attention, and at some point fortune. Maybe we should be asking Mr. RR if it was all worth it. Or maybe ask his wife and kids in a few years if it was worth it. The truth of the matter is the waves created in this mess will get bigger before they turn into ripples.

You are right, it is no one else’s business. But, that statement does not discredit the reality that people are going to find the topic interesting. If you want to call Killam’s post garbage, go ahead. However, do not be the least bit surprised at the number of hits the post will get. Just a little while ago, some people were inquiring about the topic, so I see a reason for Killam’s two-bit reporting. And quite honestly, I think that two-bit reporters for the Enquirer have pretty good job security since they give people the gossip they crave and demand. Gossip was around long before we were born and will be thriving long after we are gone. Actually, I would consider gossip to be one of the main contributing factors that makes newspapers, coffee shops, and Facebook so popular. Last I checked, this was the AgTalk Café forum, so I see Killam’s post rather appropriate. Do you not think the IFF ordeal is discussed at the local coffee shop? What gives you the right to determine if people are allowed to talk about the situation?

Lastly, I want you to know that I will probably read all the posts about the IFF situation during my leisure time simply because I find it entertaining. I use the word entertaining because that best describes what it is to me. And, I do know fully well that the people who are directly involved in the events, which I do feel sorry for, are going to be disgusted with that statement and judge me for it. But I cannot hide the fact that is what it is to me…and probably many others who have already read into the topic.

It's not gossip.  It's not speculation.  It's fact.

Don't get me wrong...not disputing anything with you here.

The only gossip here, is the speculation from others as to where the money all dissapeared to, and it's pretty obvious it is from poor massive farming practices and grain storage management.  That might be gossip...maybe he did blow it in Vegas.

I'm going to disagree with you on that. When farming goes bad, whether it is MF Global, or a large farm operation, or a small farm operation, it is part of the fabric of farming and it is our business. I appreciate the updates, tho I am far from Illinois.

Now of course, some bring a little extra spit & fire on the issue, and sometimes that is a little much. Perhaps there is a little more guessing than facts at times, and I'll agree there doesn't need to be so much of that type of stuff.

But, the issue is important to farmers everywhere. Farming is my business, so yes it does affect me. I'm nterested in the calm discussions of this issue. I don't post much on it because Idon't know much, but the threads are interesting to me.

I'd say that its probably Killams business since he used to be a partner.....Someone that owes over 30 million dollars is going to be the business of quite a few people...I can remember 3-4 years ago when lots on here thought that RR was such a great businessman and that several even wanted to be just like him...

Makes ya wonder how they treated their customers that were cautious and conservative, and that tried to hunker down and make ends meet if they had a couple bad years instead of taking bankruptcy. Looks like enough turd sandwiches on the platter that some innocent bystanders that never even did business with ILFF will probably get fed one.

Rich...Thanks for posting this. It is good to get this info out and in the public. Not every cover of Top Producer leads to success, and if they arent willing to do a follow up, well at least we have a forum here to do so.

In regards to how they could lose that much money, in so little time...is it possible he was actually pre-paying his "eh" shares?

A few thoughts here:

  1. While it's completely legitimate to discuss any lessons that might be learned from ILLFF's issues, it's probably best to avoid the opinion of a former business partner with an axe to grind.  It's like asking an ex-wife her thoughts about her former husband after a nasty divorce...you won't get the whole story.
  2. Killam's links are fine, but he's also using the forum to attack someone who has never publicly defended himself.  If the shoe were on the other foot, would Killam be so casual about name-calling and spreading local gossip?

  3. If Killam is truly hoping to recoup anything from his former business partnership, is it advisable to poison the well and publicly stir the pot while bankruptcy proceedings are ongoing?  Anyhow, it doesn't take much of a man to trash-talk on the internet.

  4. If Killam got hoodwinked by "Tricky Ricky" into a partnership, does he now oppose the tactics the business was using during their time together (big cash renting, heavy debt leveraging, lots of equipment, etc.)?  If Rosentreter was such a despicable shyster, why was Killam in business with him?  Money problems of his own?  Bandwagon-hopping to the next big thing?  I'd love to hear the other side of that story.  Either Killam didn't do his due diligence, ignored the warning signs due to need or greed, or simply wanted to make more money.  None of those reflect particularly well.

  5. Killam seems to be happy to share specific information.  Is it his business to spread what might in fact be confidential information, such as possibly privately-agreed-upon custom rates?
While it's true that Rick was gladly the subject of articles and such, and is therefore fair game for public discussion, my rational sense says that threads like this do nothing except stir up emotion and contribute to the spread of hard feelings.  I also suspect that Killam is counting on threads like this showing up on Google searches for "ILLFF" or "Rick Rosentreter" or whatever...he must be thrilled when someone mentions they read about Rick's issues on here, and they found it from a web search.  Killam uses Dropbox, so obviously he's a little more tech-saavy than your garden-variety farmer.  Perhaps you guys are simply being baited into helping him bust his former partner's chops on the web.

Ya'll, it's Christmas time.  Take a break from watching the corpse of ILLFF swinging from the rope.  If Killam wants to marinate in his own anger, let him.  There's plenty of time to beat a dead horse later.

I have an oil company that is leasing drill sites/right of way from me go bankrupt.

Dollars not big but because of provincial law I am in a position that I can't stop the company from access, cancel the contracts for non-payment or enforce any of the contract terms.

Bankruptcy is a public affair, documents are public and it certainly would not be unethical to warn people about doing business with a high roller ( or a german owned oil company).

People put a lot of faith in someone's inherent honesty, sometimes when dealing with MF Global (or Lehman brothers) that fundemental assumption is violated.

American honesty is going to take a licking (and so will the trust in the security of an American investment) if "so sorry, too bad" becomes the new mantra.

Canadian laws and business tradition have always been a bit on the tacky side compared to the US.

Its bad enough to debase your currency, if it leads to a debasement of the basic American ethic it will be catastrophic.

You need to keep all involved in mind. Now he has a right to bust his chops, so does anyone else involved with that bunch. We've all seen guys like them if you've got any age on you, I've been threw this kind of mess when someone gets a better idea and gets a bank to go along with them. You are not involved until they go broke and hangs the bank with 20 mil or so and then the bank has to recoup those losses. Guess who gets to do that, yes you know who, those old conservative ones who make money for them every year. They will be the one who pays the higher rates, the more paper work and needs some more assets to make this loan work crap that always comes from the failure of one of these idiots, I'm sorry better farmers. As far as his family he's not concerned with feeding his family, he was too busy feeding his ego but we as good neighbors should be and will be. Now I'm not one of his neighbors, I'm 800 miles from you but I'm still concerned for the people there. They are the ones, the vendors the small guys who will lose they're butts trying to over come this guy and his disciples . All I can do is say good luck and merry Christmas.

I remember there was also a younger guy named Matt Weyen that was in on ILLFF too. Brought his grandpas 600 or so acres into the operation. Is he happily farming on his own again or is he still affiliated with ILLFF?

What is unethical about what Matt Weyen did? He called on landowners to solicit their business. Pretty sure I have had two different banks call on our operation this fall, trying to get our business away from our current lender. Was that unethical? Farming is a business...get off of your moral high horse.

Most of us have no dog in this fight. But a lot of us can learn from what went down here. And I learn from what other folks have posted on this forum.

Would you read a rental contract a little closer because some outfit had a goofy cancellation clause put in their contract?

Would you take some of the promoted 'best practices' with a bit more caution, and try something on a smaller scale before committing your entire operation to it?

From other sections-

Would you write a land purchase agreement just a bit different after learning about other folks buying land with easments that make it hard to farm?

Would you look at a CRP contract a bit closer before you leased some land, or bought the land?

Would you leave your money in a floating account at a brokerage house, because nobody has lost cash there before?

Would you store your grain at the elevator, where you are an unsecured creditor? (Basically, how much are you willing to risk?)

Some of the folks here may know everything, but I can't afford to learn all of this by myself. I don't have the cash or the time. We can get hung up on the moral high ground, or the point of view being expressed, or the 'easier to say than do' responses that are proposed.

This farming stuff can be tougher than it seems to be in the magazines. Not everybody has experienced that.

First I would like to thank Killam for posting this information. I know some dont agree. I am not from the Carlinville area but know enough to understand how the rise and fall has occured. The area in question for those of you not familiar with Illinois is mostly flat, black, and very productive soils. There are a number of big operators in this area. And when I mean big I mean really big. I don't pretend to know how many acres these operations cover. Competition between these high rollers has been part of the equation to the failure of ILLFF. Competition to see who is the biggest and paying the highest cash rent was essentially the game they were playing. Evidently the game is over for ILLFF. Several of ILLFF big time competitiors do farm in my area, don't really like it, but that is their right. Their appetitie for more and more acres drives them further and further from their home base and has resulted in higher cash rents for almost everyone. Land owners hear what kind of cash rent these people are paying and want the same, can not blame them. It basically turns into the dog chasing it's tail, obviously Mr. Rosentrader caught his tail. Just a note for understanding, I don't play this game, don't want to, and not going to start. Am I jealous? Always the come back isn't it! NO. I am not going to lose everything I have trying to be one of the big boys. Just not interested. I like my little corner of the world, don't need everyone elses corner with it.
But these people and the landowners have the right to do what they do. Freedom is not free, and many have died fighting for the rights we have, including making some pretty stupid decisions that come back and bite you on the butt. And not all of my decisons have been right either, but you will not find me in bankrupty court or sticking a knife in someones back to take their land away from them.

LIke you, I don't find the "jealousy" accusation being thrown quite so often in post replies towards those questioning the motives or longevity of operations such as the now defunct ILFF, etal. For the past 2-3 yrs here on NAT, it was often thrown at those who questioned the "how" of such mega-operations, and mostly by those far remoted from the C IL area. Those same questioners are now pointing out that they do understand....and understand as they suspected. Nowhere do I see "jealous" any longer in the replies. I personally didn't think anyone was ever jealous....just cynical, and now apparently rightly so.

Hey killam, if you are out there. Went thru some of the filings. It shows 678,000 dollars transferred fom the business to rick and amy in the fall of 2010. It is listed "storage". that is expensive storage, don't you think?

Bankruptcy is a federal case; I hope the trustee digs into some of these records. I can’t help but looking at the statement under every page that requires his signature.

 “Penalty for making a false statement or concealing property: Fine of up to $500,000 or imprisonment for up to 5 years or both. 18 U.S.C. §§ 152 and 3571.”

The amount you are talking about is about what he charged the farm for grain storage. It was around from .20 to .30 cents per bushel, no matter if it was filled or not. He has around 3 million bushels storage plus 800k in two erected bins that he could not complete since 2009. This is what it took to make his payments. We went round and round about this figure. The problem is that he collected this amount of money and it does not appear that he paid the bank note off with any of it. It also appears that he did not pay his mom and brother rent for their farms and bins, but he took his. There are lots and lots of problems with all of these numbers.

What a mess. A lot to learn from this for both sides. I'm sure if he was still ridin high people that bash him wouldn't be so fast to critizise him. I would say with his payroll, and machinery costs and the fact that his land was full of water until June in a lot of places and then it burns up the rest of the year didn't help. Sure he paid high rents that really got the community up in arms, but those land lords were quick to take the money. I bet he actually lost more that 4 or even 500$ per acre in 2011 alone. All weather related. I don't condone what happened here, especially the running of the rents to sky high levels, but if that opportunity presented itself to other farmers I know, they would jump on that band wagon so fast it would make your head spin. Hypocrites they all are. Farmers should stick together like glue and they would control the entire food chain, instead they work against eachother at almost every turn. I have farmed since 1985 and see it everywhere everyday. A farmer is part gypsy and part stupid. The farm economy IS going to see a crash in the next year or two that will make the early 80's seem like a cake walk. Get prepared, because it is coming. "Black Land" will sell for less than $2000.00 dollars an acre again. We will see $2.80 corn again. When that happens and many file for protection, will you be one? Those who judge will be judged and not necessarily in the afterlife. My advise: mind your own business and get prepared for the biggest farm depression in the history of the United States . It will make the IFF case seem like a distant memory.
