| Question for those who have purchased farms with pivot irrigation on them. Can you comment if an irrigation pivot is ever included on the warranty deed. If not, is it common to have it put into a separate bill of sale or is the normal purchase/sale agreement for the property enough to convey ownership of the pivots. The purchase and sale agreement i have in place on a piece of property specifically mentions the pivots as a description of the property but i'm getting conflicting comments from an attorney on how it is conveyed. I believe the issue here is whether irrigation is considered a fixture or not and obviously there are some differences depending on the type of irrigation, but on this farm specifically they are pivots.
