Fortunately I have an excellent attorney and great cpa, but not everyone has access too competent advisors . The reason the government taxes capital gains is because it's easy money. A smaller cross section of populace and the potential tax is a larger amount than chasing other revenue. It boils down to income redistribution which historically does not work.
If they are selling land for buck thirty five square foot, as in the OP, they ought to be able to find access to competent advisors.
