It's not a failed swing as it made new highs - albeit barely. So price expressed enough energy to make new highs or if you want to use buyers and sellers, the buyers were willing to buy enough to make new highs. It then carries a different meaning into the future than a failed swing does. Like I said before a higher low, isn't a higher low, isnt a higher low. They are different and one way to tell is by simply looking at what price did after the higher low.
