| The ruling by the Supreme Court only deals with the reciprocal tariffs put in place under the administration when they thought they had power under the IEEPA. Tariffs that were imposed under sections such as section 201 and 301 of 1974 trade act also section 232 of the Trade expansion act are not subject to the Supreme Court ruling. if Supreme Court did over rule his authority, this would result in only a decrease of an average of 8% points on the existing tariffs.
The monies that would end up getting returned would be given to the importer that paid for them. The importer would be able to keep the money for themselves if they so chose.
No doubt if the administration loses they would either try to get congressional approval of tariffs, or claim that the overruled tariffs should have been classified under one of the existing trade laws that are not subject to ruling.
