Depends how it is written up. If payment for damages no tax vs payment for easement is taxed as income. So best bet is get them to write it up as much as damages as legally possible.



Why would a damage payment not be considered ordinary income?


Not 100% sure but if property cannot be returned to original value it can be considered damages. Had a very large gas line that come through a couple farms of ours and a large percentage was 1099 as damages and not subject to any tax.
