I could do them any time I'm sober and pass...Hell, I passed them after a number of beers one night years ago. This guy stumbled and fumbled. Now whether the officer's initial inclination to ask him to perform them is up in the air...I didn't see probable cause for that, but I wasn't there. And he could have been on something that wasn't on the list of tested items....for instance, I've seen a friend act drunk/high on Xanax...not sure if they test for that.
