Like I said, there may be an easement attached to his property. Since you said it used to be a lane, I would say it is likely. But I don't know about Canada.
I bought a property that only had access via an easement over the neighbor's property. But the easement was permanently attached in the 1960s. It conveyed with the property when I bought it. Neighbors HAVE to allow me access via that road. Very common.
