In Iowa I was told a dog on the road is an act of nature and the operator of a vehicle does not have to swerve or take any measures to avoid hitting the animal. So in these cases the driver is responsible for their actions.
I wouldn't hold your breath on that. If you are in an area with leash laws, the dog owner is responsible for the damages done to any vehicle that hits it. Similar, if a cow gets out and gets hit on the road, the insurer of the vehicle will come back to that farmers liability policy and try to get payment (livestock liability). |
