Columbia City, IN | My inlaws bought a 40 acre farm and I called in before the deal to confirm nothing was determined wetland. I was told no. It's been in CRP for 20 years.
In the first quarter of 2012 the CRP was re-enrolled and for whatever reason there was a wetlands determination. 10 acres of woods (which I planned to clear) was deere ones a wetland. Another area by the road was determined wet as well. Interestingly, the previous owner dug a small test hole/pond and the wetland line goes through the middle of the hole.
The 30 days to appeal the certification have come and gone. The Inlaws purchased the property in Nov 13'.
What are my options? Can the new owners appeal? Can I not sign up as the operator and take out the trees? Could my father in law be the operator but not sign up for any payments.
Is there any recourse or are we screwed? | |
