I agree completely. Since you're dealing with three parties, it's a little different from the "neighboring" farmer you don't want to open up on with both barrels right off the bat. Certified letter, township/county/state drainage resources?, and lawyer or do it and send them the bill would be my order of things.

Fencing and drainage laws are not often enforced at the township level anymore, even though they're still on the books, IN MY LIMITED EXPERIENCE, that's the only reason I doubt a drainage mediator, but that's the perfect solution if you can find such a thing.
