My culvert is below water but the gate stops the ditch from back flowing into mine. It lets my surface water out fast before the ditch comes up that high(unless we are just flooded anyway).
My lawyer seems to feel they have liability in this situation. If I can't get my crop planted or it gets flooded it would be a liability issue. He said since they weren't given a written/recorded easement this verbal agreement to let them install a tile through mine would be considered a "license". He said a license is revokable at anytime so that is why he always recommends a legal easement. Basically he said don't go plug it but with proper legal channels that could end up being the end result if they aren't willing to fix it to acceptable standards.
