"water's natural flow" doesn't necessarily mean that water actually flows there, but if the pond on the neighbor's got deep enough, where would it start overflowing first.

That said, from what you describe about the ditch with the levy, this main needs a check valve at the ditch so that it doesn't get back pressure from the ditch and a lift station with a pump should be installed on your property to pump over the levy when water level is high in the ditch.

Not sure what your actual legal right is in this situation, but I'd ask for the owner of the main to stand the cost if your land didn't receive this water prior to the tile installation.
