not seeing the layout, I would assume an easement would be needed. I work for a government agency in Ohio, We have several instances where roadway outlets run through farms quite a ways to open ditches and creeks, They are all documented in easements, albeit some are 100 years old, but they still have a record. I know you cant stop someones water if it is the natural flow, but that would not mean they would not need an easement at least. I would go to the county engineer about it.
