Depends on the drainage laws of your state. Many states follow the "natural flow " rule which suggests what neighbor is doing is unlawful. What is neighbors reasoning? Its important to work to get along with neighbors. Next step may be talking to attorney if neighbor is unwilling to remove dam. Sorry about the trouble.
