sort of right. A 1099 is only for a contractor. If they are paid for time, use your equipment, or some other qualifiers they are employees and require a W-2

That is correct.  My short timers that pick rock bring their own equipment (five gallon bucket) and show up as they please to complete the task.  Therefore, independent contractors.  I have been audited and faired well.
