Thumb of Michigan | A will is usually 'revocable' (in most cases), that's why there is usually a cause going something like this " I here by revoke all previous wills" or something along that line.. A will can be thought of as a instruction manual for the probate court (or not if specific instructions are not spelled out). Once death happens, the latest will is normally the one used (with possible fights over the mental capacity of the will maker, naturally).
There's usually right or wrong answer, BUT a well versed estate attorney could very well be a wise choice, to help figure out the possible best course of action to 'fit' the desired outcome. I think of it as being similar to the game of chess, what do you want to give up, to achieve the desired outcome. | |
