As executor I am not taking anything. The lawyer has proposed a fee of 1% on non probate and 1.5% of probate assets. Just checking to see if this is an acceptable %. I really question the LLC assets as being a probate item when there is a clear page labeled Schedule A. Each of the children are listed with a 25% share TOD (transfer on death)
I would propose lawyer gets paid hourly fee, if he doesn't accept find one that will.
Hourly fee is a good idea if you can find one to accept it. On a simple as estate with sizable assets, the percentage fee is outrageous. Personally I am going to look into setting up a trust and all pod registered accounts to try to minimize there fees.
