"Here" its common for new tenant to pay for the fall tillage/ fertilizer if contract is terminated/ land sold over winter. I don't know how they have it in the contract, but it's often noted on the sale bill, "X$/ac to be paid for fall tillage. In addition to sale price."
My contract states no fall tillage work can be done with out a contract, at the time I did tillage (early November 2020 I had a contract stating I was to farm the ground in 2021 & 2022 it was not until December 21, 2020 that the original contract holder passed away that supposedly voided the contract. |
