it is my understanding that a wetland infraction throws a complete farm and farming entity out of compliance with NRCS and USDA. it was also my understanding that the "teeth" of such an infraction meant that you were essentially "blacklisted" and unable to receive any benefits in regards to crop insurance/govt payments - that means "prospective" tenants and potential farm owners.

You will need to check on when the determination was completed. You MAY still have time to appeal the preliminary decision. after that, you might choose to remediate the tree-cleared area by establishing a man made wetland in a different spot on your farm under the construction design of NRCS - that means cutting/digging/plugging current established tile in the constructed area.

Talking to a lawyer in your home state would be extremely beneficial.
