There are state and federal rules on accrued paid time off (PTO). If an employee has accrued PTO it has to be paid to them as if it was a wage owed to them. Sick leave does not need to be paid as the employee only takes it as needed. That is why many places no longer offer sick leave but include it in their PTO.

If your employee is given 80 hours of vacation at the beginning of the year, you owe that pay to them. If you give 8 hours a month then only what they have accrued until their termination is owed. Most places allow PTO by the month or some by the quarter. Where my wife works she is given a % for every hour she works. So if she works overtime she gets more, if she is taking PTO she accrues nothing, only working hours count.


My daughter works for a big hotel chain, that's how her PTO works. She gets a percentage of hours. I don't know if it has to be "so many" accumulated before she can use them.
