Got a cattle deputy in your county? I know we do "here", that helps us deal with problem situations like this. I would get his advice about what's legal if possible.
Otherwise my vote would be haul him to the sale and tell the neighbor he has been hauled to the sale and will be auctioned. And make sure he understands you will be sending him a bill for hauling the bull to the auction. Get your animals tested in the fall. Make sure what's what.
