Ages ago a local farmer ask about lowering a culvert under a railroad tp allow gravity drainage from a new installation of tile, railroad said it could be done. They required insurance, using their crews to remove rail and ties, ballast and excavate the road bed. He was to pay for the new culvert. Actual cost was reportedly reasonable, the railroad wanted a 3 day period to conduct the work and it would be on their time table. He declined their proposal and sourced some impressive sump pumps which required 3 phase and 480 volt to run. Problem was the power was on the wrong side of the railroad right-of-way. He got a meter installed across from where he needed power, used his D8 Cat to push a 2 inch galvanized pipe with a cap on it thru the rail bed, took the cap off, pulled his power line thru to his pumps. All was good until the railroads track inspector found the questionable installation. Railroad called the power company which promptly cut of his power and pulled the meter. Now he was interested in the previously rejected compromise, but the railroad said no dice, no way and no to lowering the culvert. He eventually had to run a parallel powerline 1/2 mile to supply power to his pumps. Trespass definitely had its cost in this case. Railroad is gone, he sold the property, new owners removed the rail bed and filled in the second ditch leaving just one county drain along the old rail bed. Second now unused powerline was also removed.
