Subject: RE: What are my options with employees who smoke?

My initial thoughts were that you can't prevent an employee from smoking on the job.  You can say "these are areas where you can smoke, and these are areas where you can't smoke.", but you can't prohibit smoking.  Those were my initial thoughts.

So, I went to the Kansas Dept of Labor website to see if I could find something on that website pertaining to workplace conditions.  On that website, I typed "smoking" into their search engine and I came up with a document that says something to the effect Kansas Dept of Labor is committed to providing a smokefree workplace. That is for their employees.

So, now I am thinking maybe you have more room to have restrictions that what I first envisioned.  My suggestion is to go to the Kansas Dept of Labor website, find a contact person on there, and fire off an email to see if you can get some kind of information on what the law says about smoking and workplace rules (that pertain to you).
