Subject: Unpaid Custom Work, what to do

Long story short. We did custom work for another person. This person has failed to pay us and has been given ample time, more than a year. Checked into court/attorney and was told it only works if they have money to pay. We know since then she has made poor decisions and has lost significant amount of money and most likely can't pay. Anybody have similar situation before? I wondered if I can send her a 1099 and deduct the lost income from our taxes this year? I thought I would see what's been done here before I drag all the paperwork to my accountant.
