Edit, as an admittedly very rusty attorney, I read this article many times and I didn't see where the pickup driver admitted anything. I would say, if all the prosecutors have is an open container, they will have to really play up the leaving the scene charge. I would guess it gets plead out and a lot of people will be upset. Sorry to say, but an open container implies nothing except that he had an open container, legally speaking.
