it involves the fact that some RR rights of way only really allowed for RR tracks and nothing else (or whatever else was specifically specified) because of course back then fiber optics was probably not even imagined yet

it is the same as if you have a pipeline right of way and even if the pipeline is on the surface that does not mean next week the right of way holder can suddenly lay RR tracks because they have a "right of way" (unless the right of way involves the right to pretty much do anything

or if you have a power line right of way that does not mean they can suddenly come in and run a pipeline as well even if below the surface

so yes some lawyer out there did look at the fact that a RR right of way does not mean they can run a natural gas pipeline if they feel like it as well and then he decided that probably means they can not even run fiber optics as well and the lawsuits were on
