If you gross over 10,000.............which is likely with the gooseneck...........you will be subject to DOT regs, including log, health certif, etc etc...............the burden of showing that you are not in commerce at that time would of course be on you, especially since you would be hauling the type of implement used in your business.

Of course, if one does not go thru the scales, or stays off the major highways, one would probably not meet a DOT type.
