Usually you wind up fighting over how much is it worth, not if they can take it. If the taking significantly impacts the remainder of the property they can be forced to take the whole property. That is called "inverse condemnation" in Virginia. Here they can file a "Certificate of Taking" and pay what their appraisal says the property is worth into Court. This acts to transfer the title of the property to the entity. You then have the option of accepting their figure or fighting the valuation in Court. I went through this when they widened the road through my farm to dual lane back in the late '80's.
