We have been trying to decide what to do about this. Basically my brother's landlord's cows got into his corn and wrecked the field and he doesn't care at all.

This field is 20 miles from home, the guy asked us to tear up his hay for him last year and since my brother needed the ground even though it's kinda far to try and keep an eye on the pivot he took it. Last year the corn did about 120 bushel, would have been better but had a lot of stand problems the first year from all the gophers. This year he had a real good stand, it looked good when I sprayed it. Did everything that should have gotten at least 145, fertilized for 165.

Close to harvest landlord called, we had just been there a couple days before checking moisture and knew it would be about a week. He said "hey you should come combine this corn, my cows got out in it". Brother told him we would soon as it dried a little more. We assumed, like you would, that he had gotten the cows out. Go over there 4 days later to check moisture again and there are cows out in it. Brother calls him and leaves a message asking him to get them out. We head over next day with the combine. Get there and cows are still all out. Landlord sees us there and comes over with fourwheeler and chases them away. Not sure he had chased them any other time before then the way the field looked.

Of course as happens when you really need to combine we broke down. Blew the high pressure reverse hydro hose, took a couple days of messing around driving all over to get it repaired so it would hold, it blew off twice more before we got it going. Every time we came back the cows were in the field again.

Now I understand cows get out, we fed ours all summer and fall to keep them in because we had no rain so no pasture. This guy has 400 bales from up to 5 years ago sitting there but didn't want to feed them. I really think he didn't want to keep them in at all.

Finally got done, the corn made 82 bushel, only harvested 100 acres of 105 planted. You can see right on the map how they destroyed the outside, it was planted to the boundary and we didn't even bother with all the end rows. One spot where we quit for the night and came back they destroyed that entire corner. He tried to say that was deer but if he can't tell the difference between deer and cattle tracks and poop then he is a more sorry rancher than I thought. You can even see on the map the spot where 40 head ran all the way through the field and knocked all the corn down. He didn't even notice, I went and chased them back to where he was getting a couple others in.

So, everyone that we asked here has said a variation of "yeah he was a terrible farmer and jerk that's why he moved from here over to there and married a gal with land and went to ranching instead" and also "I sure as hell wouldn't pay him the second half of the rent". Around here cash rent is normally half in spring, half after harvest. He actually called the day after we got done there and demanded his check, brother said he had kinda hoped he was calling to say sorry about the cows and guy got all mad and said not his problem and we were assholes for thinking he should apologize. So since he was so unpleasant we are waiting until the end of the month as the contract allows while deciding what to do. Everyone is telling us not to pay him since it looks like his cows ate more than the entire years rent, but we do have a written contract and I hate to not keep to it. Doesn't look likely we will have the ground again anyway the way the guy talked. Several people told us they would never have dealt with him at all, but we didn't know that before... The worst part is this is the only pivot my brother had, all his other ground was flood irrigated and with no rain flood ground was all terrible this year. This was the only place he thought he would make money and then he got hit by this. And before it is asked, 82 is just above the guarantee there with the county yield and his 1 year before. Also it comes out to 82 with the scale tickets figuring the harvested area, obviously a bit lower with 5 more acres planted but still just above the guarantee.
