A Durable Power of Attorney gives another person the right and duty to take care of business. A Health Care Power of Attorney gives another person the right and duty to make health care decisions. These decisions typically involve treatments, medications, status of health, and the "plug or unplug" situation. The form includes options for the person who is giving the POA to state how they want their health care decided. For example, one person may state that they want kept alive at all costs. Another might state that "reasonable attempts" to keep them alive are desired.

Without a Health Care Power of Attorney, a Judge will make these decisions, if the person is unable. The Doctor cannot just let the family decide what to do. Typically, the HCPOA is given to the hospital and doctors, so they have a contact to share health information.

The Durable POA and the Health Care POA do not have to be the same person. Typically, there is a list of persons who have agreed to do the job, and they go to the second one on the list if the first one is "unable or unwilling".

Internet has lots of generic forms. Your family attorney can help you get going.

DO NOT WAIT, if you want the family to make decisions instead of someone else.
