Subject: RE: ucc filing

Stearns County, Minnesota

IADAVE - 11/30/2022 11:17 When making a UCC filing in Iowa what is the preferred way to state collateral.? I see one listed as all assets now owned or hereafter acquired,. Does that also include savings checking accounts etc?

What I state here, is MN law.  If you make a loan or a note on property, either real estate or machinery, etc., your UCC filing must state the item, with serial number, with real estate, the legal description, and this must be filed within 20 days of the signing of the note or loan.  If you fail to get it filed within that time, chances are another lender will have a blanket lien against the person you are making the loan to.  This will really make your filing only worth, the paper it is written on, because it is too late.  Yes, I would say a blanket lien, includes saving, checking, etc. which the borrower accumulates after the blanket lien is made.
