There's a couple things and I'm referencing FAA Part 107 rules.
1. The drone must be in visual line of sight. If you couldn't see it, perhaps the pilot couldn't either. So that would be a violation.
2. You can prohibit someone from taking off and landing from your property, but if they are in the air from across your fence line, they can fly over your property.
My opinion is you should be asked before someone flies over your land. However, some of these nutty drone pilots could care less and are careless. They have no Part 107 license or the newest TRUST certificate for flying recreational. IMHO - what is going to happen is Congress is going to mandate tighter restrictions due to the lack of adherence to the present drone law. I think Senator Mike Lee is at the forefront of some of these proposed legislation initiatives.
