I was told about a John Deere lawn and garden dealership locally (Iowa) that played fast and loose with the tax exempt forms. They got audited and all of a sudden found that they owed a lot of money for mowers and equipment that were not legitimately exempt. They were liable, and had to go back to customers and ask them to pay up, which some apparently did, and some did not. That's what a manager at another repair shop told me when I asked about sales tax on my bill. He said we charge everyone unless they ask, and then they have to have a tax exempt form on file. I have since heard the same story from a local welding shop who charges everyone, no exceptions, but he claims you can file to get it back. I don't think my business there amounts to enough tax to make it worthwhile looking into it.

If you didn't sign a form claiming you were exempt and they just didn't charge the tax, I'd bet that they are technically liable. On the other hand, it is tax that you apparently legitimately owed, so I don't think it's right to make them eat it, even if you can. Be glad you got a 2 year break on it.
