Yes, tax laws have altered the nature of transition from one generation to the next for a long time now, and not in a good way. Sometimes the short term tax savings ends up being a tail that wags the dog in the long run, and some people in general like to control things remotely from their office without getting their hands dirty enough to really know or care about how it affects others. Ignorance is bliss for them. Things need to be done right in the beginning, at the beginning of the day. No amount of land or money will make a lot of difference in one's life after the clock strikes midnight. I'd suggest the original poster contact a lawyer that would keep the customer's best interest as a priority (difficult to know that for certain) to see what can be done and if it is really worth doing at this point. Sometimes it's best to put a bad deal behind you and make the best of what you have. That's easier said than done.
