Estate is a hard thing to deal with. As a parent you like to be fair and equal. Sometimes those are not the same.
Often through the years many things have been passed on and not recorded like a contribution for someone to buy there own home. Or if one child is working with you on farm they have probably contributed much in labour if notably living on fewer $$ taken from farm income.
So being fair is not necessarily equal That can look bad in will but not so bad if division happens a little at a time before the final divisions.
I also will not try to 'rule from the grave'
i have also told all the kids when all were present since they will inherit some land that if they can not agree on how to manage the land then they should sell and divide the proceeds equally and NOT pay lawyers to fight over it.
It will be out of my hands then and I trust they will work together to manage things since at least one property has a couple reasons to remain under their control for at least some time into the future and hopefully grandchildren will benefit too in the future.
Yes land prices have created a BIG stumbling block for passing things to next generation. Capital gains exemption does not help much in todays market |
